General terms and conditions
I. PURPOSE AND SCOPE OF APPLICATION
The purpose of these provisions is to regulate the use of the electronic sales services for the various goods and services offered by LACTEOS CUQUERELLA S.L., hereinafter referred to as QUESOS EL HIDALGO, a commercial company operating via the Internet through its website www.quesoselhidalgo.com, selling to its customers the displayed products (sheep’s milk cheeses, goat’s milk cheeses, mixed-milk cheeses, and Manchego cheese with the Campomancha designation of origin).
The clauses set out below constitute the framework contract that all users accessing the website www.quesoselhidalgo.com are obliged to be aware of and accept. For the purposes of these General Terms and Conditions, the term “user” refers to any Internet user accessing the www.quesoselhidalgo.com website, whether directly or via another website.
The services offered by QUESOS EL HIDALGO on this website shall be governed by the terms contained in this contract. QUESOS EL HIDALGO reserves the right to modify, in whole or in part, these General Terms and Conditions, with any new terms taking effect from the moment they are published on the website. In any case, such modifications shall not have retroactive effect on goods or services already contracted by users.
These General Terms bind both parties and form an integral and inseparable part of the sales contract, which becomes effective at the moment the customer places an order, through the contracting mechanisms described herein, in accordance with Article 1,255 of the Spanish Civil Code, which upholds the principle of contractual freedom and agreements between the contracting parties. For all purposes, placing an order shall be deemed acceptance by the user of the conditions and rules of use set out herein.
To fully guarantee the rights of QUESOS EL HIDALGO’s consumers and users, these General Terms are established in accordance with Spanish law, and in particular with Law 3/2014 of 27 March amending the consolidated text of the General Law for the Protection of Consumers and Users and other supplementary laws; Law 7/1998 of 13 April on General Contracting Conditions; Law 7/1996 of 15 January on Retail Trade Regulation; the Spanish Civil Code; Directive 2000/31/EC of the European Parliament and of the Council of 8 June; Royal Decree-Law 7/2021 on the sale of goods and the supply of digital content or services; and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
II. IDENTIFICATION AND REGISTERED NAME OF THE OFFERING COMPANY
LACTEOS CUQUERELLA S.L., with registered office at Avenida de Madrid-Andalucía A-43 KM 172.5, Manzanares 13200 (Ciudad Real), Tax ID B13516620, provides its electronic sales services via the Internet through its website www.quesoselhidalgo.com.
Its contact address is cuquerella@quesoselhidalgo.com. For complaints, the address to be used shall be the registered office of the company as indicated above.
III. OBJECT
These General Terms and Conditions govern the contracting of products and services offered by QUESOS EL HIDALGO and the advertising addressed to its customers/users through its website, as well as the rights and obligations of the parties arising from the sales transactions concluded between them.
IV. LEGAL CONDITIONS FOR SERVICE PROVISION AND LIABILITY – CLARITY AND TRANSPARENCY OF INFORMATION
In compliance with the provisions of Article 10 of Law 34/2002 of 11 July, QUESOS EL HIDALGO, through its website and these General Terms and Conditions, ensures permanent, easy, direct, and free electronic access to comprehensive information regarding its registered name (tax, registry, and address details, as well as communication address), as well as to the client’s personal data held by the company, access to which is restricted exclusively to the client.
V. USER/CUSTOMER ACCESS CONDITIONS
The user of QUESOS EL HIDALGO’s website has the right to free and unrestricted access to the public information contained therein. However, QUESOS EL HIDALGO reserves the right to restrict access to certain information, promotions, and special offers to its registered customers.
Any user accessing the QUESOS EL HIDALGO website is entitled to register as a customer, thereby becoming eligible for special offers available to the registered customer group, provided that they meet the specific conditions stipulated for each product.
The public information contained on the QUESOS EL HIDALGO website referring both to QUESOS EL HIDALGO itself and to the trademarks, products, logos, and other elements of wholesalers and manufacturers of the products and services offered, is protected by legal provisions on intellectual and industrial property. Therefore, copying, transmission, assignment, sale, or use by the customer for purposes other than the advertising purpose of its online publication—without the express consent of QUESOS EL HIDALGO, the product manufacturer, or the owner of the trademarks and logos—is prohibited, as set forth in Section XI on Industrial and Intellectual Property Rights.
Guest Checkout: www.quesoselhidalgo.com allows purchases to be made through its guest checkout function. In this purchase mode, only the data essential for processing the order will be requested. Once the purchase process has been completed, the user will be offered the option to register as a user or continue as a non-registered user.
VI. OFFER AND ACCEPTANCE PROCESS – TERMS OF SALE AND PRODUCT DELIVERY
Pricing Policy:
QUESOS EL HIDALGO reserves the unilateral right, at any time, to modify the prices of the products and services offered through its website. To ensure certainty and security for the customer, the applicable price will be the one shown in the advertisement at the time the order is placed.
The electronic purchasing process will follow the steps outlined in the menu of options provided on the QUESOS EL HIDALGO website:
- Product information for the customer: description, manufacturer’s brand, indicative photograph (where applicable).
- The purchased product may undergo non-substantial modifications in its components, characteristics, or performance due to manufacturer availability, provided that these changes do not reduce the quality or advertised features.
- Product price information: the final sale price (including VAT) will be indicated, along with shipping costs, prior to confirming the order. The final cost will therefore be communicated to the customer during the electronic purchasing process before they formally accept it by selecting the “order acceptance” option from the menu.
- Any discounts or promotional gifts will be offered at the sole discretion of QUESOS EL HIDALGO to specifically designated groups or according to the product offered, as per the current advertising on the website.
Order Acceptance:
When the order is formally placed by selecting the “order acceptance” menu option, the customer’s consent to the validity and enforceability of the sales contract—binding both parties—is deemed granted. QUESOS EL HIDALGO will store the order electronically.
The obligation of QUESOS EL HIDALGO to sell and deliver the goods offered is subject to the availability of the advertised product and stock levels. While QUESOS EL HIDALGO strives to ensure that advertised products remain available, exceptional circumstances—such as simultaneous interactive orders or other situations causing stock depletion—may result in the order and the contract being cancelled under this termination clause, with full reimbursement of any amounts prepaid by the customer. In such cases, neither party shall be entitled to compensation for breach of contract, consequential loss, or loss of profit.
QUESOS EL HIDALGO will confirm acceptance of the order to the customer via email. The sale will not be final until QUESOS EL HIDALGO confirms the order. The company reserves the right not to confirm an order for specific reasons such as product supply issues, problems related to the order received (e.g., illegible documents), an abnormal order, or foreseeable delivery problems. In such cases, the customer will be informed.
All orders are subject to product availability. Should difficulties arise regarding product supply or if items are out of stock, any amounts paid will be refunded.

Invoice:
QUESOS EL HIDALGO will issue an invoice in electronic format (PDF), sent via email once the sale is completed. In compliance with applicable regulations (Royal Decree 1496/2003 on Invoicing Rules, as amended by Royal Decree 87/2005), sales invoices cannot be subsequently modified. The invoice will be issued in the name of the individual or company placing the order; therefore, the customer must ensure that the order is placed with the correct name. No changes will be possible afterwards.
QUESOS EL HIDALGO informs that a shipping surcharge of €5 will be applied to purchases under €100. Shipping will be free for orders exceeding this amount.
Delivery Timeframe:
- Mainland Spain: 48 hours.
- Balearic Islands, Canary Islands, Ceuta, and Melilla: 7 working days.
- Outside Spanish territory: 5 to 10 working days.
The delivery time starts from the next working day after the purchase. Orders placed on weekends or public holidays will be prepared on the following working day. For example, if you place your order after 1:00 p.m. on Friday, it will be prepared on Monday and delivered according to the location of your address.
Delivery Location and Method:
Unless unforeseen or exceptional circumstances arise, products will be shipped to the address provided in the form via a transport agency. Orders cannot be delivered to P.O. boxes, hotels, other non-permanent addresses, or public bodies with private postal codes.
If it is not possible to deliver your order to the specified address, we will attempt to contact you by telephone and will make a second delivery attempt. If we cannot reach you, we will try to find a safe place to leave your order. If no safe place can be found, the order will be returned to our warehouse. A note will be left explaining where your order is and how to arrange for redelivery.
If you will not be at the delivery address at the agreed time, please contact us to arrange delivery on another date.
VII. PRODUCT WARRANTY
The supplied products are covered by a two-year warranty against manufacturing defects. In the event a manufacturing defect is detected, the customer must notify QUESOS EL HIDALGO within a maximum period of two months from the date of purchase. Once the products have been examined by QUESOS EL HIDALGO’s quality department, if a manufacturing defect is confirmed, QUESOS EL HIDALGO will inform the customer of such finding and, if the nature of the product permits, offer its replacement with an identical item or a refund of the amount paid if replacement is not possible due to lack of stock.
QUESOS EL HIDALGO shall not be liable for damages resulting from misuse or improper handling. The warranty will be void in cases of external factors unrelated to the normal use of the product by the customer or caused by third parties not authorised by the manufacturer. The warranty period shall commence on the date of delivery.
VIII. CUSTOMER RIGHTS
- Confidentiality and security of customers’ personal data in accordance with current Spanish data protection legislation.
- No dissemination, transmission, or publication of customers’ data without their express consent.
- No receipt of promotional or advertising emails if such communications have been declined.
- Right to consult, modify, and delete personal data stored in QUESOS EL HIDALGO’s database at the customer’s request, in accordance with the section on Personal Data Protection.
- Free access to open sections of QUESOS EL HIDALGO’s website.
- Right to be informed at any time of the status of order processing.
Returns
Right of Withdrawal / Unilateral Cancellation of the Order:
In accordance with Article 104 of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Defence of Consumers and Users, the customer (considered a “consumer” or “user” only if the product is acquired, used, or enjoyed as a final recipient) is entitled to revoke the order within fourteen (14) days from receipt, subject to prior notification to QUESOS EL HIDALGO within this period so that appropriate return procedures (return number, method, and delivery address) can be arranged. Only the price paid for the product will be refunded.
If the right of withdrawal is exercised, the customer shall bear the cost of return shipping as well as any depreciation in the value of the goods. Returns will not be accepted in cases of use, broken seals, or opened packaging of cheese products, except where recorded on the delivery note. Return costs will be deducted from the product price at the time of refund. No returns or exchanges will be handled at our registered office.
QUESOS EL HIDALGO will not accept returns of products that have been tampered with by the customer, or goods returned incomplete (including missing main elements or accessories). The right of withdrawal shall not apply after the stated deadline or to goods which, by their nature, cannot be returned. It will also not apply to goods or orders deemed custom-made to the customer’s specifications.
As per Article 103 of the General Law for the Defence of Consumers and Users, the following items are excluded from return:
- Customised products manufactured according to the consumer’s exact specifications.
- Sealed goods not suitable for return due to health protection or hygiene reasons that have been unsealed after delivery.
- Goods that may deteriorate or expire rapidly.

Professionals: Persons or entities who acquire, store, use, or consume goods or services not as final recipients, but with the intention of integrating them into production, transformation, marketing, or provision to third parties, will not be considered consumers or users and will therefore not benefit from consumer rights.
Instructions for Returning Products:
Returned goods will not be handled directly at our premises but must be delivered to the designated carrier for shipment. To avoid damage or incidents, smaller products must be protected by external packaging—as originally received at your address—thus preventing any damage or tampering with the original product packaging during transport. For larger products, external packaging is not essential, but the product must be securely packed in its original box with protective materials intended for this purpose (such as cork, polystyrene, bubble wrap, etc.) and without any tampering. IX. OBLIGATIONS OF THE USER/CUSTOMER
- Safeguard their personal access credentials with due diligence.
- Use the information published by QUESOS EL HIDALGO exclusively within the strict context of the intended personal commercial relationship.
- Not reproduce, transfer, or otherwise dispose of any of QUESOS EL HIDALGO’s published content without the express permission of the company.
- Make faithful use of the purchasing service provided by QUESOS EL HIDALGO on its website, refraining from tampering with the content or interfering with its IT systems through viruses or any other conduct prohibited by law.
- Honour the purchase agreement once the order has been accepted, with timely payment of the agreed price.
X. RIGHTS OF QUESOS EL HIDALGO
- Retain, modify, or suspend its website without prior notice.
- Change the prices of offers.
- Reject orders due to lack of stock or non-payment by the customer.
- Deny access to IT tools to customers in the event of non-compliance with these terms and conditions.
- Receive payment for purchases from the customer once the transaction is accepted.
- Retain ownership and full title to the goods until full payment has been received from the customer.
- Reserve the right to conduct raffles or prize draws for goods or services on its website.
XI. APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed by the statutory and regulatory provisions of Spanish law.
The parties expressly waive any jurisdiction that may correspond to them and agree to submit to the Courts and Tribunals of the judicial district of the seller (Manzanares – Ciudad Real) for the resolution of any disputes that may arise from the interpretation or execution of these terms and conditions.
